New rules for the Fast-Track examination of H04 applications

The Brazilian Patent and Trademark Office (BRPTO) published, on September 1, 2026, in Official Gazette No. 2904, Ordinance No. 07/2026, updating the rules for fast-track examination of patent applications under the IPC main classification H04.
This new Ordinance revokes Ordinance No. 5/2026 and establishes that the BRPTO shall accept up to three fast-track examination requests per month, per applicant, of patent applications classified under IPC H04.
It is important to note that these limitations do not apply to some fast-track programs such as the ones for elderly applicants, applicants with disabilities or severe illnesses, pursuant to Article 69-A of Law No. 9784/1999, and to startups. Eligible applicants in these categories may continue to request accelerated examination for their H04 applications, provided that they meet the applicable requirements. Ordinance No. 07/2026 took effect on its publication date.
