New Public Consultation: Electronic Games Registration

The Brazilian Patent and Trademark Office (BRPTO) published, on August 25, 2026, in its Official Gazette No. 2903, the Public Consultation No. 2/2026, aimed at collecting contributions from the productive sector, academy, civil society, and other interested parties regarding the regulation of games registration procedure. 

The initiative was driven by the 2024’s amendment to the Brazilian Industrial Property Statute (Law No. 9279/1996) which recognized electronic games as assets protected under said statute, with registration to be made before the BRPTO.  

The current regulatory challenge lies in the absence of normative instruments or administrative rules capable of enabling, in a clear, predictable, and legally secure manner, the granting of electronic game registrations by the BRPTO.  

Interested parties have until October 26, 2026 (60-day term) to submit comments on said subject. Contributions will be assessed for regulatory impact to identify needs, verify adequacy, evaluate potential effects on regulatory measures, and propose alternatives for appropriately addressing and structuring the matter.
