New Public Consultation: Fast-track of Industrial Designs

The Brazilian Patent and Trademark Office (BRPTO) published, on September 8, 2026, Public Consultation No. 2/2026, aimed at collecting contributions from interested parties regarding the regulation of priority examination programs for industrial design applications.  

The draft proposal under consultation regulates fast-track programs provided by Law No. 9.784/1999, as those applicable to elderly applicants, individuals with physical or mental disabilities, and persons suffering from severe illnesses; and introduces fast-track modalities for designs involved in judicial disputes, related to products or services whose patents benefited from acceleration programs may qualify for expedited examination, ICTs (Scientific, Technological and Innovation Institution), Start-ups, among others. It also suggests the limitation of requirements for Phase I of the program. 

Interested parties may submit comments and contributions through the BRPTO’s website or the Brasil Participativo Platform until October 23, 2026, corresponding to a 45-day consultation period. Following the deadline, the BRPTO will evaluate and consolidate the submissions received, and provide a draft proposal for the Industrial Design Handbook.
